Grandparent Rights

Under certain circumstances a grandparent has the same standing (right) as a parent to seek custody of a grandchild.  If a grandchild resides with a grandparent in a stable relationship, the court may recognize that the grandparent has the same standing as a parent and may make the grandparent the primary caregiver.  Idaho Code §32-717(3).

Under other circumstances, a grandparent or a great grandparent may be entitled to court-ordered visitation under Idaho Code§32-719.
