Child Custody Modification

Changes in families may occur which make it necessary to modify the Initial Custody Determination. In making a Custody Modification, the Court must determine whether there has been a “substantial, material and permanent change of circumstances” since the last custody order. If there has been such a change, the Court may modify the custody order to better serve the best interest of the children. The Court will use the same factors, found in Idaho Code §32-717, that it used in making the Initial Custody Determination.
